TERMS OF USE

Travel Zeg (“we” or “Travel Zeg“) provides a platform to book travel packages (e.g. multi-day travel itineraries) via its internet platform available at www.travelzeg.com (“Travel Zeg Platform” or “Platform“).

Team TravelZeg and Trip Advisors handle all your booking related queries. Trip Advisors / Team TravelZeg will get in touch with the guest via e-mail / telephone / Skype / websites. Once we receive the deposit amount (as advised by Trip Advisor / Team TravelZeg) and once on receipt and completion of the Participant Information Form (PIF), you’re booking will be finalized. The other details are as mentioned below for your ready information

Acceptance of Terms

By using the Travel Zeg Platform, you confirm that you have read and understood both these Terms of Use and the Privacy Policy of Travel Zeg and that you agree to the Terms of Use and the Privacy Policy.

1.1 Passports and Visas

All travelers listed on the PIF must be in possession of a valid passport and all relevant visas. It is client’s responsibility to ensure about the valid travel documentation, including but not only limited to passports and visas that meet the requirements of immigration and other government authorities at every destination. Please refer to the nearest Consulate for more information regarding visa requirements. All passports require at least 6 months validity from the planned date of departure. Any fines, penalties, payments or expenses incurred as a result of non-completion of such documents will be the client’s responsibility. Team TravelZeg or SkyZeg Private Limited does not hold any responsibility for completion of the above documents.

Attention: Attention: If the travel itinerary includes travel to India and any other country (Nepal, Bhutan, Tibet, Sri Lanka etc), multiple entry Indian Tourist visa will be required. You will be required to present your travel itinerary and documentation at the time of application for the visa. TT can provide you with the necessary travel documentation upon request.

1.2 Non Transferable

 

We would like to take the liberty if mentioning that all documents which are related to your travel provided and issued by Team TravelZeg cannot be transferred. They are non-transferable. Some are but will be subject to amendments fees as applicable. They are applicable to amendments in the dates as well.

 

1.3. Health and Safety Information

Team TravelZeg advises to regularly consult your country of residence’s department of foreign affairs website. Team TravelZeg advises to regularly consult the information provided by the proper authorities on the medical risks associated with the country you are travelling. It is client’s responsibility to be aware of any health requirements for the travel destinations and to ensure about carrying all necessary vaccination documentation. Please consult your travel doctor for more information.

Changes to the Platform

Travel Zeg reserves the right to change the content, structure, functions, etc., of the Travel Zeg Platform, to add new functions, partially or fully suspend existing content and functions temporarily or permanently, as well as to attach selected functions to the fulfillment of certain conditions, at any time and without notice.

Conditions of Cancellation

All cancellations of bookings are chargeable. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced or not where any amount has been incurred by Team TravelZeg or SkyZeg Private Limited on account of any change in booking advised by client, you agree to indemnify us for that amount.

To cancel your booking with Team TravelZeg (SkyZeg Pvt. Ltd), please notify your travel insurance company and Team TravelZeg (SkyZeg Pvt. Ltd) in writing through e-mail/letter, stating the reason for the cancellation. Request Team TravelZeg for acknowledgement of receipt of your email or letter. Cancellation fees will be calculated according to the date of receipt of the written request regarding the cancellation of your booking. Please read your travel insurance policy carefully or contact your insurance provider to determine the policy conditions, level of cover and documentation required to make a claim against cancellation penalties charged by Team TravelZeg (SkyZeg Pvt. Ltd) or any of its suppliers.

Cancellation Fees

Cancellation fees for all confirmed bookings where a Booking Confirmation has been issued and deposit has been received by Team TravelZeg (SkyZeg Private Limited) are detailed here with exception of cases covered at Booking Terms:

Cancellation more than 30 days prior to departure: 50% deposit paid will be refunded after making the following deductions: bank charges (20 €), booking fee (45 €), flight cancellation fee (20 € per person per ticket, except in the case of non-refundable airfares, where 100% of the cost of the ticket will be deducted). Along with the actual cost of the train tickets if booked. Cancellation less than 30 days prior to departure: 50% cancellation fee applies. SkyZeg Pvt Ltd will retain the 50% deposit paid at the time of booking confirmation.

Bhutan Bookings – Cancellation less than 30 days prior to departure: 100% cancellation fee applies. No amount will be refunded on Bhutan bookings that are cancelled within 30 days of travel.

Please advise Team TravelZeg for the cancellation of your booking as early as possible by e-mail, telephone, or fax. Most of the hotels, airlines and suppliers charge a 100% cancellation penalty for cancellations between 7 days and 24 hours of departure. Team TravelZeg ( SkyZeg Private Limited) will be unable to provide refund for any such bookings.

For any booking, either fixed group departure or customized itinerary, if one or more participant travellers cancel their booking, and the itinerary still be travelled by one or more participants, the per person price for the booking will be increased by cost of the cancelled participants share divided by the number of remaining participants. Any refusal of acceptance of the new per person cost will be regarded as a cancellation of the booking, and will be subject to the cancellation fees mentioned above.

Cancellation fees for partial cancellation (valid for fixed departure group itineraries). If one or more participant registered on the same itinerary cancels their participation in an itinerary that still be maintained for the other participants, the cancellation fees mentioned above will be calculated for the participant who cancels on:

The per person cost of the services remaining unused at the time of cancellation for example flights and rail tickets

The full cost of the booking for the services booked on a group basis divided by the number of participants for example ground transportation and hotels

Refunds. All refunds will be processed within 12 weeks from the date of cancellation.

Duty to Protect your Own Computer

Travel Zeg in no way guarantees that you will have perfect reception and availability of the Services offered on the Platform or the Platform itself, particularly as the availability depends on your computer and your own internet connection. In particular, you must ensure that your computer is adequately protected so that unauthorized third parties cannot access your computer, your system or your Account using technical attacks and spread viruses, spyware or other damaging programs.

Account Termination

In the event of unauthorized use of the Platform or a material breach by you of these Terms of Use or the Booking Terms we may, in our discretion, without any liability or obligation to refund any costs to you and with immediate effect: (a) terminate your access to the Platform; (b) deactivate or delete any of your Accounts and all related information and files in such Accounts as well as your content; and (c) bar your access to any of such files or content.

Changes to these Terms of Use

These Terms of Use were last updated on June 30th 2013.

Travel Zeg reserves the right to update (add or change) these Terms of Use at any time without prior notice. The most current version of the Terms of Use is available at http://www.travelzeg.com/website/about/terms-of-use.

Invalidity

If any provision or part of a provision of these Terms of Use is found by any court or authority of competent jurisdiction to be unlawful, otherwise invalid or unenforceable, such provision or part-provision will be struck out of these Terms of Use and the remainder of these Terms of Use will apply as if the offending provision or part-provision had never been agreed.

Assignment

You may not transfer any of your rights or obligations under these Terms of Use without our prior written consent. Travel Zeg may transfer any of its rights or obligations under these Terms of Use without your prior written consent.

Applicable Law and Jurisdiction

Any dispute resulting from the usage of the Travel Zeg Platform or concerning these Terms of Use is exclusively subject to Swiss law.

Sole place of jurisdiction in connection with any disputes concerning these Terms of Use shall be New Delhi, India.

BOOKING TERMS

Acceptance of Terms

With your booking of a travel package via the Travel Zeg Platform, you confirm to have read, understood and expressly agreed to these Booking Terms. The current version of the Booking Terms can anytime be read under the following address: http://www.travelzeg.com/website/about/booking-terms

With respect of your usage of the Travel Zeg Platform, you also agree to the Terms of Use and the Privacy Policy. Terms of Use and the Privacy Policy of TravelZeg.

Price

All prices are subject to availability and can be withdrawn or changed without notice.

Fixed Departure Group Itinerary Bookings

Please refer our website for all prices. The price per person for the itinerary is based on the minimum number of participants mentioned in the offer of the itinerary (generally 2 participants). If less than the minimum numbers of participants register for the itinerary, Team TravelZeg may need to change some components or logistics of the itinerary in order to guarantee the departure specified in our offer. In the event of this occurring, Team TravelZeg may need to charge an additional “small groups” charge. You will be notified of this charge at least 21 days prior to the departure of the itinerary. This charge will be refunded if the minimum number of participants is achieved for the itinerary.

After the confirmation of the booking, the price of the itinerary can be changed if the price of flights, transport, hotels or activities exceeds the price that was budgeted for in our quoted price for the itinerary. This supplement will be advised to you in the final invoice that will be e-mailed to you at least one week prior to departure.

“Ala carte” and Customized Itinerary Bookings

Team TravelZeg gives you the option to personalize your itinerary, activities; mode of transport and to give you flexibility in travel dates, however until the itinerary and the travel dates are fixed, the prices are subject to change. The price of the itinerary will be quoted to you on the travel itinerary provided to you by Team TravelZeg; this price is valid for 7 days or as per the validity date, whichever is the sooner.

After the confirmation of the booking, the price of the itinerary can be changed if the price of flights, transport, hotels or activities exceeds the price that was budgeted for in our quoted price for the itinerary. This supplement will be advised to you in the final invoice that will be e-mailed to you at least one week prior to departure.

All Travel Bookings

All prices are valid for 7 days. After the aforementioned period, all prices are subject to change due to currency fluctuations. All quotes are subject to availability. Please confirm your booking as soon as possible to secure the quoted price and availability. All prices are subject to change until paid in full due to currency fluctuations or government tax increases. After the deposit has been received, the outstanding balance is due 21 days prior to arrival. This balance amount is subject to change. If due to currency fluctuations or increase in govt. tax, the difference between the price quoted at the time of booking (at the time of receipt of advance) and at the time of final payment, is more than 5%, revised quote will be applicable. The same will be informed to you accordingly at least 21 days prior to arrival.

For any booking, either fixed or customized itinerary, if one or more participant travelers cancel their booking, and the itinerary will still be traveled by one or more participant travelers, the per person price for the booking will be increased by cost of the cancelled participants share divided by the number of remaining participants. Any refusal of acceptance of the new per person cost will be regarded as a cancellation of the booking, and will be subject to the cancellation fees mentioned in Terms of use

Refusal to pay any reasonable adjustments to the price of the itinerary will be regarded as a cancellation of the booking.

Insurance

Team TravelZeg (SkyZeg Pvt. Ltd) and its Directors are insured against professional and civil liability by__________________________________________________!

Liability: Team TravelZeg (SkyZeg Pvt. Ltd) does not accept any liability of whatever nature, whether in contract, tort or otherwise, for the acts, omissions or default, whether negligent or otherwise, of any service provider, over whom we have no direct control. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. We do not accept any liability in contract, tort or otherwise for any injury, damage, loss, delay, additional expense or inconvenience caused directly or indirectly by force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. In particular, but without limitation to these conditions, we accept no responsibility for any loss, damage or injury you suffer as a result of terrorism, war (including civil-war), coup, riot, civil disturbance or any type of criminal act or any unforeseen circumstances beyond. It is your responsibility to inform yourself about the safety and security situation in the places you are travelling to.

Travel Insurance: Team TravelZeg (SkyZeg Pvt. Ltd) recommends that you take a personal travel insurance policy including repatriation cover to protect you against the above mentioned risks. Team SkyZeg(SDU Travels Pvt. Ltd) does not provide travel insurance. Please ensure that you take out a travel insurance policy that covers you for any adventure activities that you are participating in such as mountain trekking or scuba diving. For travel to high mountain regions and alpine areas, a specific insurance policy covering the expenses of search, rescue and repatriation in the event of an accident or illness is required. You will be asked to provide a copy of your travel insurance policy to Team TravelZeg (SkyZeg Pvt. Ltd) as well as policy details when you complete the Participant Information form at the time of booking. Team TravelZeg (SkyZeg Pvt. Ltd) also requests that to provide the contact details for a person to contact in case of any emergency. Please make sure to have a copy of your travel insurance policy with you at all times. You shall be responsible for lodging any claims on your travel insurance policy (our guides and local staff assist you if required). Team TravelZeg (SkyZeg Pvt. Ltd) will assist you by contacting your Travel Insurance provider if you are incapacitated or unable to contact them, and will provide the invoices of any expenses incurred by you.

Additional booking information to consider.

At the time of making and quoting the travel itinerary, Team TravelZeg (SkyZeg Pvt. Ltd.) considers that the first and last day of the itinerary are entirely devoted to travel to and from the country of origin. Any change in above may affect the final cost of the itinerary.

All of our travel itineraries unless otherwise stated, are based on twin share accommodation. Single rooms may be available on request, if available Team TravelZeg will advise of the additional cost which will be shown as a supplement on the itinerary and quotation.

Special Terms and Conditions for High Altitude Mountain Itineraries:

Supervisory staff chosen by Team TravelZeg (SkyZeg Pvt. Ltd.) or its partners to accompany a group of travellers (guides for high mountain treks, guides for medium mountain treks etc) may from time to time modify the planned itinerary to ensure the safety and enjoyment of the travellers, and to account for any unforeseen circumstances. Team TravelZeg (SkyZeg Pvt. Ltd.) , via its representatives or staff, may also according to the climactic conditions, physical competency of the travellers and/or situations that arise, modify or adapt the itinerary and/or request the presence of an additional guide. Any additional expenses in these situations will be the responsibility of the travellers. If any participant decides not to complete the itinerary for whatever reason, Team TravelZeg (SkyZeg Pvt. Ltd.) will not provide any refund.

After the booking has been confirmed, it is possible to extend the itinerary. Team TravelZeg (SkyZeg Pvt. Ltd.) will create a new itinerary and quotation. Any additional services and expenses will be invoiced to you by Team TravelZeg (SkyZeg Pvt. Ltd.) according to the changes required. The new invoice will be emailed to you 21 days prior to arrival. All changes and requests are subject to availability.

During the travel, you will get a direct phone number of the Travel Experts for in-destination assistance.

Miscellaneous

Time Zones and Working Days

For time and date calculations, the time zone of the location of the corresponding activity as part of the Travel Itinerary shall apply if not stated otherwise.

Working Days” in these Booking Terms shall mean any day on which the banks in the registered seat are running normal business and are open.

PRIVACY POLICY

We at Travel Zeg understand that providing your personal information to book your holidays online requires a great deal of trust on your side. We are working hard to ensure the security and confidentiality of the personal information you provide to us. Travel Zeg employs several security professionals who implement the technical and organizational security measures. Travel Zeg takes measures to protect personal information against loss, misuse, unauthorized access, unauthorized disclosure, manipulation, or destruction.

This privacy policy sets the basis on which any personal data we collect from you or that you provide to us will be processed and protected by us. By using the Travel Zeg Platform, you explicitly agree to the following terms and conditions of this Privacy Policy in its last updated version.

Maximum numbers of participants in fixed departure group itineraries and participants who are under the age of 18 years.

Unless otherwise stated, the maximum number of participants in any fixed departure group itinerary is 12 people. However, the maximum number can be increased if any of the participants are travelling with another person on a twin share basis. The services will not be modified and the itinerary, activities, services, inclusions and price will be identical.

Team TravelZeg (SkyZeg Pvt. Ltd) will only accept bookings from people of 18 years age or older. Any booking for an unaccompanied minor will be confirmed by Team TravelZeg (SkyZeg Pvt. Ltd) only with the prior written consent of the parents or legal guardian. All unaccompanied minors must carry the relevant exit documents from their country of origins authorities permitting them to travel abroad without parents or legal guardian. Any minor who travel with only one parent, teachers or other unrelated adults, it is advisable to carry prior written consent of the parents or legal guardian and all official documents necessary to permit travel without both the parents and legal guardian. The minor traveller should also carry the travel itinerary, as well as the name, addresses and telephone numbers of his/her parents or legal guardian.

Responsibility

Travel Vouchers, flight tickets or any other travel documents lost by the traveller Negligence or otherwise for which we have no control of any service provider Passport, visa. Vaccinations, Travel Insurance etc, which are invalid, expired or not adequate Any loss, damage or injury, suffer as a result of unforeseeable and insurmountable incidents or events including but not limited to: terrorism, war (including civil-war), coup, riot, civil disturbance or any type of criminal act, strikes external to Team TravelZeg (SkyZeg Pvt. Ltd) , technical or administrative failures external to Team TravelZeg (SkyZeg Pvt. Ltd) , obstruction of airspace, bankruptcy of a supplier or partner of Team TravelZeg (SkyZeg Pvt. Ltd) , bad weather, natural disaster, delays, including delays in postal services in the case of sending replacement plane tickets, passports etc, breakdowns, loss of luggage or other personal effects or misconnection of flights or other modes of transport. Any delays or necessary changes to an itinerary due to the above mentioned causes will be at the expense of the traveller. Team TravelZeg (SkyZeg Pvt. Ltd) will not provide any compensation or refunds in such situations. Possible additional expenses related to any of the situations mentioned above including but not limited to taxes, hotel, car park fees or replacement and /or reissue of travel documents will remain the responsibility of the traveller.

Team TravelZeg (SkyZeg Pvt. Ltd) reserves the right to change the dates, schedules or routes of itineraries, or cancel bookings to ensure the safety of the travellers and/or at the injunction of an administrative authority, as necessitated by unforeseeable and unforeseen circumstances and incidents or events as mentioned above or otherwise. In this case Team TravelZeg (SkyZeg Pvt. Ltd) will calculate the unused portion of travel and deduct cancellation fees. The remaining amount will be held in credit for future use by the participant. If the credit is not enough to cover any new travel bookings, the difference will be paid by the participant.

If you do not make the payment / refuse to pay for any reasonable adjustments made to the cost of / price of the tour, it will be treated as a cancelled booking

Agent

Team TravelZeg (SkyZeg Pvt. Ltd) acts as a travel agent only. It sells various travel related products on behalf of numerous transport and accommodation service providers, such as airlines, coach/rail and cruise line operators. Team SkyZeg’s Travel’s only obligation is to make travel bookings on your behalf and to arrange relevant contracts between the client and the travel service providers. Team TravelZeg (SkyZeg Pvt. Ltd) has no responsibility for these services, nor do it has authority to make any warranty or representation regarding their standard. All bookings are subject to the terms and conditions and limitations of liability imposed by these service providers. Your legal recourse is against the specific provider not Team TravelZeg (SkyZeg Pvt. Ltd).

Complaints

All complaints are to be sent via by registered post and addressed to TravelZeg (SkyZeg Pvt. Ltd), New Delhi, India. Please do not delay in contacting us in the event of a complaint, and ensure that you enclose all supporting documents. Disputes, if any, are subject to the local courts in Delhi.
